Is it legal for an employer to demand your gratuites?

Restaurant next to my place of work, according to my coworkers, confies their waiters' gratuities and is most definately guilty of other unethical behaviors as well, such as tax evasion. Unfortunately, at this point I don't have any hard evidence to support any allegations. Is there any authority whom I could solicit to investigate the matter?
